1. REVISED STANDARDIZED PHARMACY NOTICE (CMS-10147)

Part-D 환자들이 Cover 되지 않는 처방약에대하여  보험회사에 appeal 할 수있는 권리를 규정한 PHARMACY NOTICE를,  지난해까지는 약국에서 환자들이 볼 수만 있도록 Post만 해도 되었던 규정이, 올해 부터는 “환자에게 직접 나누어 주어야한다” 고 규정이 바뀌었습니다.  따라서 첨부한 양식을 미리 복사해 약국에 비치해 놓으시고 커버되지않는 처방을 가져오는 모든환자에게 반드시 나누어 주셔야합니다 (첨부양식참조)

Beginning with the 2012 plan year, this version of the pharmacy notice must be provided to Part D enrollees when a prescription cannot be covered (“filled”) under the Medicare Part D benefit at the point-of-sale (POS).

The regulation requires distribution of this written notice as of January 1, 2012.

2. Medical 10% cut과 함께 Medical 환자에게 copay를 부과 하려던 주정부의 계획이 연방정부(CMS)에 의해 부결되었다는 반가운 소식입니다. 10% cut에대한 소송에도 유리하게 작용하게  될것입니다

CMS Denies Medi-Cal Copay 

We have received some additional positive news related to the array of provider cuts announced last fall by DHCS. As you will recall, the Department proposed implementing mandatory copays for beneficiaries at the same time they submitted the State Plan Amendment for the 10 percent provider cuts.  We have learned that the Centers for Medicare & Medicaid Services have denied a State's request to impose a mandatory copayment on a vast majority of Medi-Cal beneficiaries, including preferred and non-preferred pharmacy medications.

3. 약국에서 약사,인턴, Technician, clerk 등 employee중 누구든지  만일 DUI나 약물중독 등으로 인해 그 임무를 수행할 수 없는( impairment) 경우, 또는 도둑(theft)의 피해를 보았을 경우에는  Pharmacy Board 에 앞으로는 14일 안에 보고 해야합니다

4. 오는7월 1일 부터는 모든 controlled drug처방전(security Rx)  은 비록 의사의 허락이 있다 할지라도 약국에서 임의로 고치거나 바꾸거나 할수 없습니다. 반드시 새로운 처방전을 요구해야합니다

5. 본 협회의 ACPE Accreditation을 유지하기위한 survey를 요청하였었습니다. 75명의 survey가 필요한데  오늘 현재  이미 그이상의  response를 보내 주셨습니다.  감사드리며 그 결과를 정리하여 곧 여러분들께 알려드리겠습니다

6. 지난 26일 부터 28일까지 Sacramento 에서 열린 CPhA Annual Meeting (Outlook)에 본 협회에서  이효수 회장, 마틴 이사장, 토니박 변호사가   참석하고 돌아왔습니다. 협회회원(CKAPhA) 중  총 73명의 CPhA MembershipFee를 전달하였습니다. 협조해 주심에 감사드립니다.
